Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and Ghana Jollof Restaurant, operating at 135 Main Street North, Unit #2, Brampton, ON L6X 1M9, Canada ("Ghana Jollof", "we", "our", or "us").

By accessing our website (ghanajollof.ca) or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

1. Eligibility

You must be at least 18 years of age to create an account or place an order. By using our website, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

2. Our Services

Ghana Jollof Restaurant provides an online platform enabling customers to:

  • Browse our menu and view item descriptions, prices, and allergen notes.
  • Place food orders for in-store pickup or local delivery within our delivery zones.
  • Create an account to track orders and manage saved preferences.
  • Submit catering and event inquiries.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice, without liability to you.

3. Menu, Pricing, and Availability

  • All prices are displayed in Canadian dollars (CAD) and are inclusive of applicable taxes where stated. The final total (including HST, service fees, delivery fees, and any tip) is shown at checkout before payment is required.
  • Prices and menu items are subject to change without notice. The price applicable to your order is the price displayed at the time your order is placed.
  • All menu items are subject to availability. If an item you ordered becomes unavailable after your order is placed, we will notify you and provide the opportunity to select a replacement or receive a refund for that item.
  • Images on the website are for illustrative purposes only. Actual products may vary slightly in appearance.

4. Placing an Order

An order is confirmed only after successful payment is processed through Stripe and you receive an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including where:

  • An item is unavailable or a pricing error has occurred.
  • We have reason to believe the order is fraudulent.
  • The delivery address falls outside our service area.
  • The minimum order threshold for your selected delivery zone is not met.

If we cancel your order after payment, you will receive a full refund via the original payment method within 5–10 business days.

5. Payment

  • Payment is collected in full at the time of order placement through Stripe, Inc., a third-party payment processor.
  • We accept major credit and debit cards as supported by Stripe. We do not accept cash through the online platform.
  • Your payment information is transmitted directly to Stripe and is never stored by Ghana Jollof Restaurant.
  • A service fee of up to 5% is applied to all orders to support platform and operational costs. This fee is displayed clearly at checkout.
  • Ontario HST (13%) is applied to all applicable items as required by law.

6. Promotions and Promo Codes

  • Promo codes are subject to specific terms stated at the time of issue, including expiry dates, minimum order values, and usage limits.
  • Only one promo code may be applied per order.
  • Promo codes have no cash value and are non-transferable.
  • We reserve the right to revoke or expire promo codes at any time without notice in the event of misuse or technical error.

7. Pickup Orders

  • Pickup orders must be collected from: 135 Main Street North, Unit #2, Brampton, ON L6X 1M9.
  • Estimated preparation times are provided in good faith and may vary based on order volume and kitchen capacity. Estimated times do not constitute a guarantee.
  • You will be notified by email when your order is ready for pickup.
  • Uncollected pickup orders will be held for 30 minutes after the "ready" notification. After this window, we cannot guarantee the condition or availability of the order, and no refund will be issued.
  • Please bring your order number (provided in your confirmation email) when collecting.

8. Delivery Orders

  • Delivery is available within our defined delivery zones in the Greater Brampton area. Delivery zones, fees, and minimum order thresholds are displayed at checkout.
  • Estimated delivery times are approximate. We are not responsible for delays caused by traffic, weather, or other circumstances beyond our control.
  • You are responsible for ensuring the delivery address is accurate and accessible. If delivery cannot be completed due to an incorrect address or inability to contact you, you may not be entitled to a refund.
  • You must be present and available to receive your order. Risk of loss passes to you upon delivery to the specified address.

9. Cancellations and Refunds

Customer-Initiated Cancellations

  • You may request to cancel your order within 5 minutes of placement, provided the kitchen has not yet begun preparation. To cancel, contact us immediately by phone at +1 (905) 452-7537. We cannot guarantee cancellation once preparation has started.
  • Cancellations requested after preparation has begun will not be eligible for a full refund.

Restaurant-Initiated Cancellations

  • If we cancel your order, you will receive a full refund to your original payment method within 5–10 business days.

Item Unavailability

  • If an item in your order is unavailable after payment, we will notify you via email and on-screen with a 3-minute window to select a replacement.
  • If you do not select a replacement within the window, the unavailable item will be removed from your order and a pro-rata refund for that item will be issued within 5–10 business days.

Quality Issues

  • If there is a genuine quality issue with your order (e.g. wrong item received, food safety concern), contact us within 2 hours of receipt with a description and photo evidence where possible. We will assess each claim individually and may offer a replacement, credit, or partial refund at our discretion.

10. Allergens and Dietary Requirements

We take food allergies seriously. Our menu pages include ingredient and allergen information to the best of our knowledge. However, our kitchen handles common allergens including peanuts, tree nuts, gluten, dairy, eggs, soy, seafood, and shellfish.

We cannot guarantee a fully allergen-free preparation environment. If you have a severe allergy or dietary restriction, please contact us directly before ordering. By placing an order, you accept responsibility for reviewing allergen information and for communicating any requirements to us in your order notes.

11. User Accounts

  • You may create an account to access order history, saved addresses, and faster checkout. You are not required to create an account to place an order.
  • You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or that we believe are being used fraudulently.

12. Prohibited Conduct

You agree not to:

  • Place fraudulent, fictitious, or test orders.
  • Use automated systems (bots, scrapers) to access or interact with our website without our express written permission.
  • Attempt to gain unauthorised access to our systems or any other user's account.
  • Use our website for any unlawful purpose or in a way that violates applicable laws or regulations.
  • Submit false, misleading, or defamatory reviews or communications.
  • Resell or commercially exploit any part of our services without our express written consent.

13. Intellectual Property

All content on this website — including text, images, logos, recipes, and code — is the property of Ghana Jollof Restaurant or its licensors and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

14. Disclaimer of Warranties

Our website and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

15. Limitation of Liability

To the fullest extent permitted by applicable Canadian law, Ghana Jollof Restaurant and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including loss of profits, loss of data, or personal injury, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim.

16. Indemnification

You agree to indemnify, defend, and hold harmless Ghana Jollof Restaurant and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or our services shall first be addressed by contacting us directly. If a resolution cannot be reached informally, disputes shall be submitted to the exclusive jurisdiction of the courts of Ontario, Canada.

18. Changes to These Terms

We may update these Terms at any time. The updated Terms will be posted on this page with a revised "Last Updated" date. For material changes, we will provide notice via email or a prominent website notification. Your continued use of our services after the effective date constitutes your acceptance of the revised Terms.
